How can we avoid the Premier League litigation firestorm coming to construction?
It was Match of the Day: Liverpool Builders (managed by James Bessey) v Norwich Disunited (managed by Richard Wade) slugged it out to explore the dispute resolution issues the industry faces in this webinar by reference to the issues football faces.
But did they act responsibly as the Government cabinet office advice suggests?
And did the referee, Kate Howell, as the funder with the money have to get involved to sort it all out?
Chairman Dominic Jones represented the Government, aimed to steer the parties away from delay claims, late PC, LD’s, delay analysis, as well as trying to overcome difficulties with supply chains, site access and social distancing issues. All this against the backdrop of money claims and how to deal with them in the spirit of fairness.
Businesses, contractors and sole traders have taken a hit and had to react quickly during the current crisis. How we emerge is going to be key to the long-term health of the economy, but also as a sector. With so many interrupted contracts, paused construction sites, broken supply chains, there is huge potential for businesses to go on a litigation frenzy.
As with the sporting industry, the approach and attitude that construction adopts could have ramifications for many years to come. The recent guidance published by the cabinet office and construction leadership council outlines that firms should act responsibly and fairly when enforcing contract behaviour when impacted by COVID-19.
The question is, what does this look like and how should you interpret this? How can you protect your business whilst maintaining a careful view of the health of the sector?
This construction webinar discussed how the issues facing construction are those which face other industries, including sport and how sensible dispute resolution can play an important role.
