Now live: Privy Council Rules and online Case Management Portal
Earlier this year we reported on the Judicial Committee of the Privy Council (JCPC) Change Programme and Consultation on sweeping changes to the JCPC Rules and procedures regarding Privy Council cases. The new JCPC Rules and Practice Directions, together with new website and online case management portal are now live. JCPC Change Programme and launch of new Rules and website/portal
The new JCPC Rules are part of a wider three-year Change Programme at the UK Supreme Court. The Change Programme is intended to deliver a world-leading service which is user-friendly and modern. It includes the delivery of a new online case management system (the “Portal”), new website, updated processes and ways of working. The aim is to enhance justice for all and increase public trust in the public sector, both domestically and internationally.
The new processes come into operation on 4 December 2024 with the launch of the new website and online case management portal.
Summary of key points
- All new appeals and Permission to Appeal applications filed from 4 December 2024 onwards will have to be filed online via the Portal.
- All existing appeals remain governed by the previous 2009 Rules and Practice Directions and will not be eligible to go on the Portal.
- Service of Notice of Appeals is via traditional methods but, thereafter, for represented parties, all service of case documents will be online via the Portal.
- The process for listing hearings is changing significantly and will take place earlier than previously.
- All appeals will be subject to a case management procedure.
- As part of case management, all “As of Right” appeals will be referred for an early review as to whether the appeal seeks to overturn concurrent findings of fact as per the rule in Devi v Roy. Such appeals will be referred for a short case management hearing at which the appeal may be dismissed.
- The JCPC website will be a pathway to the new Portal, which will enable users to file court documents digitally and track the progress of their case. The Portal will interact with the website by, for example, publishing online updates on cases drawn from new information uploaded to the Portal.
- Publication of appeal documents such as Written Cases will take place unless an application is made beforehand to prevent publication.
