Blake Morgan lawyers in innovative food allergy mock trial online seminar
Blake Morgan are collaborating with Food Allergy Aware to run a Mock Trial Food Allergy prosecution virtual event on 26 May 2021.
The Mock Trial will feature members of Blake Morgan’s Regulatory and Food Law team, including Senior Associate Barrister Tom Walker and Partner Claire Rawle. They will explore a fictional scenario of a meal being served where the allergens are incorrectly labelled. The case will follow the legal responsibilities of each entity involved in the processes in producing and serving the food. The case will also include the review of purchasing ingredients, and product recall, and assessing potential high-risk issues that need to be considered as part of the concept of due diligence.
The first event held in 2019 was hailed a great success and now Food Allergy Aware have taken the seminar online. Caroline Benjamin, Founder of Food Allergy Aware, commented: “It was a tough judgement call to go virtual, as the event involves delegate interaction and discussion as attendees deliberate over the defendant’s fate!”

Who should attend?
Anyone involved in the production of the food, serving the customer, taking bookings/orders up to the point when the customer/patient walks out the door, including all aspects of our sectors, including contract catering, and in a ‘not for profit’ environment i.e. hospitals, education and care home settings.
All food supply businesses have a legal responsibility to ensure that the products they supply are correctly described and safe to consume. The costs of getting it wrong are high. Failure to control risks in food safety can result in a criminal prosecution, regardless of whether any harm has been caused or not.
This event will demonstrate to all levels of staff from the Management Team with overall responsibility for processes through to chefs and food preparation assistants that prepare the final dishes for consumption. The session will look at their personal and corporate responsibilities and how one slip up could be fatal along with legal consequences!
Sitting in the mock court will be a Judge, Defence and Prosecution barristers, the Court Clerk, and our fictional Defendant – John Basiletti – Sole Director of Airs and Graces Ltd t/a “Baby Basiletti’s”.
The attendees will be the jury deliberating on the sentence in this interactive session.
In addition, there will be a variety of speakers in the second half of the session sharing their experiences and best practice in providing for those with special diets.
I thought the event was excellent. FATC took an important but extremely challenging concept and, alongside Blake Morgan, executed it superbly. The result was an incredibly informative and compelling conference.
