Law Commission Consultation Paper - Reform of Part 2 of the Proceeds of Crime Act 2002

The Commission say that they have: “Suggested reforms to encourage the effective use of powers to prevent assets from being dissipated before a confiscation order is made, to ensure that when confiscation orders are made they realistically reflect what a defendant gained from crime, and to improve the enforcement of confiscation orders.”
For this launch event, hosted by Blake Morgan LLP solicitors, the Law Commission were joined by experts from the Proceeds of Crime Lawyers’ Association (POCLA) and 33 Chancery Lane. Professor Penney Lewis, the Criminal Law Commissioner, and specialist lawyers from the Law Commission gave an overview of the consultation paper and the key changes being recommended and representatives of POCLA provided their initial views on the proposals.
